I. Scope
Thank you for your interest in attending one of our retreats, educations, workshops, lectures, or other events (collectively, "Event"). The following terms and conditions ("Terms"), explain the rights and responsibilities both parties have relating to the Event. In order to attend an Event, you must agree to these Terms, which form an integrated part of the final, binding contract between you (participant) and Nangten Menlang Switzerland (NMCH or we - together with its affiliates, co-sponsors, and organizers). Unless stated in a separate signed agreement, these Terms govern all Events. NMCH does not accept or agree to any differing terms. By accepting these Terms, one agree to be bound by them. Any exception or change to the Terms must be in writing by NMCH to be valid.
II. Registration
Registration for retreats
The number of participants at events of NMCH is limited. The registration is done only on the website www.tulkulobsang.org. By sending the registration form on the website, the registration is legally binding for the participant.
Registration Process
NMCH have the right to accept or reject any registrations. The participation will be informed within a reasonable time about the decision.
- If NMCH does not accept the registration, we will refund any payments which where done in conjunction with the registration.
- If registration is approved, NMCH will notify the participant by e-mail (-> "Registration Notice" ).
Please take note:
- In order to complete the registration, in addition to the reservation at Nangten Menlang Switzerland, a booking in the hotel is necessary. Seminarhotel Lihn (note: Nangten Menlang): +41 (0)55 614 64 64, info@lihn.ch . The hotel makes the room allocation.
- In case of cancellation, the entire participation fee (teaching fee + Hotel fee) is due.
The Event Terms and Conditions, together with the Registration Notice, form a binding contract.
Afterwards, NMCH will inform the participant about further information regarding to the event such as payment methods or terms of payment.
NMCH has to receive the payment for the teaching fee on time. Otherwise, a place cannot be guaranteed. Failure to pay by the stated deadline will result in immediate cancellation of this contract and your reservation for the Event. NMCH has the right to refuse participation and terminate this contract at any time for failure to make full, timely receipt of the payment at NMCH. Registration is not guaranteed until NMCH has confirmed receipt of the required payment. (-> “participation confirmation”)
One has be 18 years of age or older to attend an Event. If we open an Event to minors, parental consent is required for minors to attend unsupervised. We will provide you a consent form that must be signed by a parent and returned to NMCH before the Event. Registration is not guaranteed until we receive this parental consent. No consent form is required for minors attending with parents.
III. Payment Terms
The fee for each Event ("Participation Fee") is shown on the website and in the “Registration Notice”. Please be aware, that special payment conditions may be given. To secure your registration, one must pay the Participation Fee by the date stated in the Registration Notice. If the payment is not done by the date stated, a payment reminder will be sent by e-mail. If payment is not received within 5 business days of this message, your registration will be canceled.
For installment agreements, failure to pay on time, a payment reminder will be sent by e-mail. One must pay the overdue installment within 5 business days from the date of this notice or we will cancel your registration. If the applicable event has already occurred, NMCH will be entitled to collect the full remaining balance (including hotel costs) of the contract.
IV. Cancellation & Refund Policy of NMCH
If a event has a special cancellation policy, it will control all cancellations and refunds for that specific event and the general policy of Nangten Menlang Switzerland will not apply.
Cancellation by the participant
The participant has the right to cancel a registration. If the participant cancels the participation, NMCH charges a one time service charge and cancellation fee of 150.- CHF.
- The participant cancel the attending by sending a registered letter to Nangten Menlang Switzerland, c/o Yvonne Perdrizat, Hohlegasse 45, CH-4102 Binningen. A cancellation by E-Mail to the following address is also possible: info@tulkulobsang.ch .
- Cancellation request sent by registered mail shall be deemed dated as of the postmark and requests sent by email shall be deemed dated on the date Nangten Menlang Switzerland receives the e-Mail.
NMCH charges a one time cancellation and handling fee of 150.- CHF.

Additional Fees: If the bank transfer fee to issue your refund exceeds 10.- CHF all additional amounts will be deducted from your Refund.
Replacement participant:
The participant has simultaneously the possibility, latestly within 5 days after the cancellation, to announce a replacement participant to Nangten Menlang Switzerland. If NMCH accepts the replacement participant, the participant shall have to pay a processing fee of 150.- CHF. The replacement participant may not be registered for the specific event. There is no legal claim of acceptance of a replacement participant.
Cancellation insurance:
We recommend you consider obtaining travel insurance to cover any such expenses in case you have to cancel your registration for an Event.
Cancellation by Nangten Menlang Switzerland:
If Nangten Menlang Switzerland cancels the retreat, you shall receive a refund of 100% of participant fee (the teaching fee plus hotel fee). NMCH shall not be liable for any claims or amounts exceeding the participation fee including without limitation nonrefundable travel expenses or accommodation fees.
V. Cancellation hotel
In case of cancellation, the seminarhotel Lihn will charge the accommodation fee directly to the participant in accordance with the specific hotel cancellation policy.
VI. Ownership of Rights; Consent
The use of photographic or recording devices of any type, such as cameras, audio recorders, video recorders, or mobile devices such as cellular phones, during NMCH Events is strictly prohibited without our express prior written permission. NMCH or its partner organization (for example NMI) is the sole owner or licensee of all right, title, and interest in the Events and any materials, whether written or recorded, relating to or arising from the Events regardless of whether we make these materials available to the participants or not. Also hand out material is copyright protected material solely for private, non-commercial use. It is strictly prohibited from copying, distributing, altering, translating, displaying, publishing, uploading, or transferring ownership of the Materials.
Any such actions may constitute copyright infringement for which NMCH & its partner organization NMI can seek legal remedies including monetary damages. Any violation of this provision will be deemed a breach of these Terms and the registration contract and we shall have the right to immediately exclude you from the Event without refunding the Participation Fee.
You understand that we may photograph, video record, and audio record the Event ("Recording"), and that you may appear in the Recording. The Recording is considered part of the NMCH & its partner organization NMI Materials. The participants authorize NMCH, & NMI without any limitation or compensation, to use, publish, edit, display, distribute, edit, or translate the Recording in any media and for all purposes as NMCH & its partner organization NMI shall determine in its sole and absolute discretion. The participant further agree, that NMCH & its partner organization NMI owns all rights, title, and interest in and to the Recording and you have no ownership of or claim to the Recording.
VII. Waiver of Liability
Participant understands that the Event may involve activities of both a physical and mental nature and you assume all risk for attending the Event or participating in any Event activities. Participant agrees to accept full responsibility for yourself at the Event, including for your physical and emotional wellbeing, and for your personal belongings. NMCH shall not be held responsible in this regard. Participant hereby waives any and all claims you may have against NMCH, (including its employees, affiliates, or agents), relating to or arising from the Event and release NMCH from all liability for any injuries or damages to the participant or it belongings and/or to any third person or their belongings caused by the participant. If the foregoing waiver does not apply under the applicable law, then NMCH's liability is restricted to acts of gross negligence and intentional misconduct by NMCHʼs legal representatives or employees acting within the course and scope of their employment.
Participant is specifically advised that the Event does NOT constitute medical advice and is not a substitute for proper medical treatment. Participant is advised to consult your health care professional regarding any health concerns and also before participating in any new physical activities.
VIII. Data protection
Nangten Menlang Switzerland is aware of your personal data and handling them with care. If a retreat includes a accommodation, it is necessary to share personal data with the seminarhotel in order to complete your booking.
IX. Final Provisions
This Agreement is governed exclusively by swiss law, without reference to national standards. This Agreement shall be deemed entered into in 4102 Binningen (Switzerland) and courts in Binningen shall have exclusive jurisdiction to hear any disputes relating to this Event Terms & Conditions.
Notwithstanding the foregoing, in any contracts with consumers, if the national law in the jurisdiction where the consumer resides is more favorable to the consumer or mandates its application, that law shall apply, but only to the extent legally required.
If any provision herein is legally invalid or unenforceable, or is legally impossible to perform, that provision shall be deemed amended in a manner that makes it enforceable or possible to perform. If amendment is not practicable, the unenforceable provision shall be stricken and the remainder of the Terms shall remain in full force and effect. NMCH’s failure to insist upon or enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right. |
